Abattage religieux dans l’Union européenne: La Flandre et la Wallonie ont outrepassé leurs droits en interdisant l’abattage religieux, d’après l’Avocat Général - Le Comité de Coordination des Organisations Juives de Belgique confiant

Ce matin, l’Avocat Général a émis son avis sur la question de savoir si la Flandre et la Wallonie (et partant, d’autres autorités européennes) ont la possibilité de supprimer l’exception prévue au profit de l’abattage religieux en droit européen. Le Comité de Coordination des Organisations Juives de Belgique, CCOJB, maintient que l’interdiction pure et simple de l’abattage religieux est incompatible avec le droit européen. 

L’Avocat Général soutient la position du CCOJB et conseille à la Cour de Justice de limiter la marge de manœuvre des Etats Membres.

Yohan Benizri, président du CCOJB et Vice-Président du Congrès juif européen et du Congrès juif mondial, a déclaré: “L’Union européenne à laquelle nous adhérons avec force ne peut pas se permettre de faire voler en éclats une liberté religieuse. La démocratie se mesure d’abord et avant tout par le respect des minorités et personne ne peut mettre en cause l’intégration de notre communauté en Europe. Je veux croire que la Cour suivra également notre raisonnement.”

L’avis de l’Avocat Général est très important, mais il n’est pas contraignant pour la Cour de Justice de l’Union européenne. L’arrêt de la CJEU devrait intervenir dans quelques semaines, après quoi la procédure reprendra devant la cour constitutionnelle belge.

Religious slaughter in the European Union: Flanders and Wallonia violated EU law by prohibiting religious slaughter, AG Hogan says - The Belgian Federation of Jewish Organizations (CCOJB) is hopeful

This morning, the Advocate General of the Court of Justice of the European Union issued his opinion as to whether Flanders and Wallonia (and, by extension, other European authorities) may make the EU-law based religious slaughter exception meaningless by bluntly prohibiting religious slaughter. The Belgian Federation of Jewish Organizations argues that such blunt prohibition is incompatible with EU law.  

The Advocate General supports the CCOJB’s interpretation and advises the CJEU to restrict Member States’ margin of discretion. 

Yohan Benizri, president of the CCOJB and Vice-President of the European Jewish Congress and the World Jewish Congress, declared: “The European Union to which we wholeheartedly adhere cannot allow a religious freedom to be simply shattered like this. Democracy is first and foremost measured in light of the treatment of minorities, and no one could possibly question our community’s integration in Europe. I want to believe that the Court of Justice will also follow our reasoning in this case.”

The opinion of the Advocate General is important, but not binding. The Court’s ruling is expected in the next few weeks. After that, the proceedings in front of the Belgian Constitution Court will resume.

Brussel, 10 september 2020

Deze ochtend gaf de Advocaat-Generaal bij het Hof van Justitie van de Europese Unie zijn advies over de vraag of Vlaanderen en Wallonië (en, bij uitbreiding, andere Europese lidstaten) de in het Unierecht vervatte uitzondering voor religieus slachten betekenisloos mogen maken door religieus slachten regelrecht te verbieden. Het Coördinatiecomité van Joodse Organisaties in België argumenteert dat een dergelijk verbod onverenigbaar is met het Unierecht.

De Advocaat-Generaal steunt de interpretatie van het CCOJB en adviseert het Hof van Justitie om de beoordelingsruimte van de lidstaten te beperken.  

Yohan Benizri, de voorzitter van het CCOJB en de vicevoorzitter van het Europees Joods Congres en het Joods Wereldcongres, verklaart: “De Europese Unie, die wij een warm hart toedragen, kan niet toestaan dat een religieuze vrijheid compleet ondergraven wordt. De kracht van een democratie wordt in de eerste plaats afgemeten aan de manier waarop zij haar minderheden behandelt; niemand kan de integratie van onze gemeenschap in Europa in vraag stellen. Ik wil graag geloven dat ook het Hof van Justitie onze redenering zal volgen in deze zaak.”

De conclusie van de Advocaat-Generaal is belangrijk, maar niet bindend. De uitspraak van het Hof wordt verwacht over enkele weken. Daarna zullen de procedures hervat worden voor het Belgisch Grondwettelijk Hof.
